Interest Type Guide

What is Turkish statutory interest?

Statutory interest is governed by art. 1 of Law No. 3095; it applies to non-commercial receivables and default interest where no contractual rate is agreed. The rate was 9% p.a. from 01.01.2006 to 31.05.2024 and was raised to 24% p.a. as of 01.06.2024 by Presidential Decree No. 8485. The calculator splits periods automatically.

Note: by decision of 22.07.2025 (E.2024/24, K.2025/164), the Constitutional Court annulled art. 1 with respect to non-contractual obligations, effective 01.09.2026. New legislation should be monitored for tort-type claims after that date.

How is commercial default interest calculated?

In commercial matters, default interest follows art. 2/2 of Law No. 3095: the creditor may claim the CBRT short-term advance rate even without a contract. The applicable rate is the advance rate in force on 31 December of the previous year; if the rate on 30 June differs by five points or more, the new rate applies in the second half of the year.

For example, 49.25% applied in H1 2025 and 44.25% in H2 2025; 39.75% applies throughout 2026. The calculator derives these periods automatically from the official CBRT advance rate table.

What is TCC art. 1530 late payment interest?

TCC art. 1530 governs late payment in contracts for the supply of goods and services between commercial enterprises. Where no rate is agreed or the clause is invalid, the default rate announced by the CBRT every January applies: 48% for 2024, 53.25% for 2025, 43% for 2026.

The creditor may also claim a minimum recovery cost for collection expenses (2026: TRY 2,020) even if not agreed. This type applies only to supply relationships; choose commercial default (advance) interest for general commercial receivables.

How are rediscount and advance interest calculated?

The rediscount rate is the CBRT discount rate for bills with at most three months to maturity; the advance rate applies to short-term advance transactions. Rates are published in the Official Gazette; from 20.12.2025 the discount rate is 38.75% and the advance rate 39.75%.

For tax valuation (Tax Procedure Law art. 281 and General Communiqué No. 238), the advance rate is used for rediscounting notes receivable and payable; choose the advance type for balance-sheet-date rediscounting.

When does highest deposit interest apply?

Highest deposit interest applies primarily to employee claims: delayed severance pay (Labour Law No. 1475 art. 14) and wage claims (Labour Law No. 4857 art. 34) carry the highest interest actually applied to deposits.

Turkish Court of Cassation practice uses the rates banks actually applied, not announced rates; they are obtained from banks during enforcement. As no single official table exists, enter the rate manually; treat the result as an approximation.

Frequently Asked Questions

For term debts the debtor is in default when the due date passes; for on-demand debts default requires a formal notice (TCO art. 117). Interest accrues from the day after default. For invoiced commercial receivables the invoice due date is typically used; for court judgments, the action or default date.
